SO. here's what happened.
Two years ago I designed a pistol range for the RCMP. They were extremely happy with it and paid our company almost double the fee to design it.
Now, two years and three million shots fired later, they want to sue my ex-company. The reason? One out of those three million shots backfired and landed beside an officers foot. Of course if you are firing shots into a diffusing chamber, at LEAST one will back fire. We used the newest technologie and were told it was foolproof, which it clearly wasnt. Do you think we should be getting sued for something that would inevidably happen?

I've found out that americans sue people more then almost any other people. If that would happend here, well, it wouldn't happend here:o

sueing for something that would inevitably happen is not necessarily rediculous. For example;
A) if they purchased the equipment under the premise that this would not happen under normal use conditions
B) If it was only inevitable IF they were using YOUR equipment. (example, if they used someone elses equipment would it still have been inevitable?)
C) If your company failed to do the kind of research that would reveal the flaw.
Yeah it's sorta silly to sue over a bullet that never hit anybody...unless it is a system that could have possibly caused someone to be hit in the future and therefore the legal action prevents accidental shootings in the future. But they're gonna have a lot to prove in court, i wouldn't be too worried dude, unless of course they are guilty of A, B, and/or C.

Why would you design a range that had a flaw in it...other then of course the possibility of lead contamination into the ground which is inevitable....perhaps Canadians should figure out how to keep bullets from shooting back at themselves to lessen the likelihood of friendly fire :D

The point is WE didnt design the equipment, and we didnt assure them there would be no flaws in it, the company who designed the equipment did. Why should they be sueing us?

Well if you (by YOU I mean your ex-employer, and just Canadiens in general) provided this other company's product to the RCMP, then you should have done enough testing to determine that this could have happened (especially if it was "inevitable") and you could have warned the RCMP that this type of thing does or could happen, releasing you from liability. If it truly is INEVITABLE, then it would have happened NO MATTER WHOSE DIFFUSION CHAMBER YOU USED! If you could show that in court, and their case crumbles at their feet. However if there is a specific flaw that caused it, a flaw unique to this particular unit, your company, as a provider should have made sure that what they were providing was safe, even if only to cover your own asses. We have a phrase in America, commonly seen as the initials C Y A...Cover Your Ass.
